ELECTION: Judge Nelson is fair and unbiased

Letter by Anna K. Woods, Tacoma on Aug. 2, 2012 at 1:22 pm with 2 Comments »

We encourage voters to re-elect Pierce County Superior Court Judge Kathryn Nelson.

Nelson has served as a Superior Court judge for 12 years. We have appeared in front of her on family law, criminal and civil matters during her tenure as judge. Her intelligence, hard work and dedication to the law make her an ideal judge and one who has contributed much to the public and the legal community.

Nelson has demonstrated fair and unbiased decision-making. She is prepared for every case, even when she has to review volumes of materials. She is respectful to all litigants, including attorneys and individuals representing themselves. Further, she is not afraid to make difficult rulings.

During her time as judge, Nelson has presided over the Pierce County Superior Court Criminal, Family Court and Juvenile Court divisions of the court. She has served on numerous committees and is a member of the American Inns of Court. She works as a volunteer for various community activities, including Rotary Club, Paint Tacoma Beautiful, Tacoma Lutheran Retirement Community Foundation and has been president of her church board.

Retain a hard-working dedicated public servant and vote to keep Nelson in Department 13, Pierce County Superior Court.

(Woods wrote this on behalf of herself and 13 other lawyers.)

This definitely sounds like a glowing resume of support which overshadows the real deficiencies this Judge possesses. A lot of what she does outside of the courtroom (based on this description) doesn’t help with some of the real concerns – Family Court. When the Pierce County Court was asked whether Judge Nelson participates in any of the court mandated Parenting Seminars the answer was “No”. This is most likely a court-wide issue with all Family Court Judges, however with Judge Nelson the lack of having these seminars as part of her training is so evident its painful.

As a citizen/voter/concerned parent/tax payer, Judge Nelson hasn’t displayed any of the characteristics associated with a truly good Family Court Judge. I have personally witnessed her lackadaisical attitude and disregard for children on more than one occasion. My perception, which is echoed by many in the community, is that Judge Nelson does what is most convenient for Judge Nelson. If a sub-standard Parenting Plan is drafted by a lawyer facing a party without a lawyer, she will take the easy road regardless and choose the PP drafted by the lawyer. I’ve witnessed on multiple occasions as well as spoke with those who are not as fortunate to obtain an attorney to represent them during a Family Court case, where Judge Nelson has treated them as 2nd class citizens. She leans heavily towards parents who have an attorney to represent them. This is unfortunate as many parents do not have the extra money to hire a high-priced attorney. This gives me the impression that Judge Nelson is working the good-ole boy system especially coming from an attorney background herself.

I do believe that a complete overhaul of the Family Court in Pierce County is absolutely necessary and it starts with the Judges. There are some Judges that excel in Family Court such as Judge Arend. However, Nelson is not one of them. The statement made by the author of the above article, “She is respectful to all litigants, including attorneys and individuals representing themselves”, is as far from reality as can possibly be. I have witnessed the opposite of that statement on multiple occasions.

Which leads me to wonder whether the author of this article is a part of that good-ole boy network of lawyers and Judges who believe in the vicious cycle of over-charging lawyers, conveniently misinterpreted laws just so you have to go to court over and over again, sloppy written legal docs which require additional lawyer fees, etc etc…

What I want to see are more articles written from the real people – the public. Those who have truly experienced this Judge first-hand or through acquaintances. People who do not stand to benefit in any way. Thank you…

If Ms. Woods and her cosignatories were being entirely honest, what this letter should have said is “Vote to Re-Elect Judge Nelson. She’s not as dumb or pathetic as her opponent.” For those who spend their time in our court system, Judge Nelson does not inspire confidence or respect for our judiciary. There are reasons she found herself at the bottom of the recent county bar rankings. Unfortunately, no quality candidate choose to run against her. Her opponent, James Schoenberger, is not only a joke as a lawyer but is very likely to be Michael Hecht 2.0.
