UPDATED at 1:55 p.m.

Pierce County prosecutors today filed a second-degree murder charge against a Seattle man who allegedly killed another man outside an after-hours party near downtown Tacoma early Sunday.

Devennice Antoine Gaines, 35, pleaded not guilty during his arraigned. He was ordered held in Pierce County Jail without bail.

Gaines, who has a previous conviction for manslaughter, is charged with shooting Bruce Price to death during a confrontation outside a party hosted by a motorcycle club at a building near 23rd and Fawcett, court records show.

Gaines allegedly got into fist fight at the party with a man in a wheelchair. As Gaines later walked to his car, Price reportedly berated him from beating up a man in a wheelchair, the records show.

“Gaines was walking backward, facing Price,” the records state. “The two men were approximately five feet apart. Gaines then extracted a handgun from his waistband and fired several shot directly at Price.”

Price suffered multiple gunshot wounds and later died.

Gaines fled but was arrested Wednesday in Seattle, where he is registered as a Level I sex offender, police say.

Gaines is reportedly affiliated with a Seattle street gang while price and the man in the wheelchair are allegedly associated with a rival gang that has a presence on Tacoma’s Hilltop, court records show.

Gaines faces life in prison without the possibility of parole under the state’s “three strikes you’re out” law if convicted as charged of killing Price.

Lights & Sirens stalwart Stacey Mulick reports the following:

Gaines was charged Monday with failure to register as a sex offender in King County and a warrant had been issued for his arrest. He was convicted in 1991 of indecent liberties after he physically and sexually assaulted a girl in an empty classroom at their junior high school. Gaines was 14 at the time.

The conviction tagged him as a Level 1 sex offender, which means he was least likely to commit another sex offender. However, it required him to register his address.

Gaines also has three other criminal cases pending and was awaiting sentencing on a drunken driving charge from 2001, according to King County court records.

He was in prison from January 2003 through May 2010 after he was convicted of second-degree assault and attempted first-degree robbery.
