Pierce County Judge Nelson to stay mum on Powell case

This just in from Pierce County:

Pierce County Superior Court Judge Kathryn Nelson has no current comment on the very tragic events of Feb. 5, which involved cases assigned to her department. The Code of Judicial Conduct 2.10 prohibits comments on “pending and impending matters” that may come before a court. Since Judge Nelson cannot foresee whether related matters may come before the court, she cannot comment in the current matter.

RULE 2.10
Judicial Statements on Pending and Impending Case

(A) A judge shall not make any public statement that would reasonably be expected to affect the outcome or impair the fairness of a matter pending or impending in any court, or make any nonpublic statement that would reasonably be expected to substantially interfere with a fair trial or hearing.
