The family of Darrel Johnson, which lodged a $45 million claim against the state Department of Corrections last year, now has filed a lawsuit against the agency it claims is partly responsible for Johnson’s death.
Johnson (seen here) is the Navy veteran who was beaten and stomped to death on Tacoma’s East Side two years ago while out for his morning walk.
Johnson’s wife and children believe the state failed to properly supervise the man convicted of killing Johnson. Andrew Brown was on probation for a robbery conviction at the time of Johnson’s death.
“A proximate cause of the above described death of Darrel Johnson was gross negligence and/or other fault of the Department of Corrections in failing to supervise Andrew J. Brown,” the family contends in the lawsuit.
The suit was filed Wednesday in Pierce County Superior Court.
